Dr. Michael Naughton gives his initial thoughts on todays Royal Courts of Justice decision handed down by the Lord Chief Justice in the appeal by Simon Hall.
Whilst it is clear that there is a legal process at work here all of common humanity and those with heart are astounded that the British Legal process cannot free a man clearly innocent until the slow and grinding mechanism of the law has taken its course.
In the meantime taxpayers are providing the huge costs of miscarriage of justice, the legal profession are charging their fees, precedent and jury are protected, politics are satisfied whilst the parents leave the court before the decision because they are distraught to know their innocent son remains in jail.
This last point is very pertinent. How is it that the parents can be told the decision before the Lord Chief Justice pronounces it in the Royal Courts of Justice, thereby making the decision law in that moment, and how is it that, allegedly, all of the press and medias outlets are aware of the decision before the Lord Chief Justice makes that decision law? How is it that the innocent man, Simon Hall, is allegedly told in his cell, hours before the Lord Chief Justice gives his decision in the Royal Court of Justice, that his appeal has failed. Could we ask if this in itself is not a contempt of court!
Where is the humanity in this process and why should Simon Hall's life be the cost for a very sleepy Solomon.
